Rule

For a biological product under accelerated-approval consideration, if any promotional materials (including promotional labeling and advertisements) are intended for dissemination or publication within 120 days after anticipated marketing approval, the applicant must submit copies of that material to FDA during the preapproval review period, unless FDA has instructed otherwise.

Check

Confirm that any promotional piece slated for use within 120 days after approval was submitted to FDA for review during the preapproval review period (i.e., before or during the approval decision process, not only after approval). A violation is a piece intended for early post-approval use that was never submitted to FDA during that window, absent documented instruction from FDA excusing submission.

Escalate when

Escalate if it is unclear whether the material was intended for use within the first 120 days post-approval, whether it was actually submitted to FDA in that window, or whether FDA had otherwise excused submission.
