Multi-page Rx ads may lack fair balance if risk info isn't facing/full page

Rule

A multi-page prescription drug advertisement in which side effect and contraindication information is presented as a distinct part MAY be found lacking in fair balance or otherwise misleading under 21 CFR 202.1(e)(7)(xi) if that information is not presented on a page facing another page of the advertisement, or on another full page.

Check

For prescription drug print ads running on more than one page where side effect and contraindication information is presented as a distinct part, confirm that this part appears on a page facing another page of the same advertisement or on another full page; if it does not, flag as a potential fair-balance deficiency under 21 CFR 202.1(e)(7)(xi).

Escalate when

Escalate when it is unclear whether the piece qualifies as a multi-page advertisement subject to 202.1 (e.g., unconventional digital pagination, spreads, or foldouts), whether the drug is a prescription (versus OTC) product, or whether the side effect/contraindication content genuinely constitutes a 'distinct part' rather than being integrated throughout the copy.
