Update promotional labeling and advertising promptly after a labeling change
Rule
Once FDA-approved labeling has been changed under 601.12(f)(1) or (f)(2), the holder of the approved biologics license application must promptly revise all promotional labeling and advertising so it is consistent with the new labeling.
Check
Compare claims, warnings, dosing, and other statements in the piece against the current approved labeling; a violation looks like promotional content that still reflects a superseded version of the labeling (e.g., an old indication, dosage, or missing a newly added warning) after a labeling change has been implemented.
Escalate when
The date of the underlying labeling change or the timeliness of the revision is unclear, or it is ambiguous whether a discrepancy reflects a not-yet-incorporated labeling change versus an unrelated inaccuracy.
