Combination-ingredient ads: dosage form name and adjacent 502(n) quantities

AI-verifiedblockerBinding lawRaised as a question — a person decides

Rule

This rule applies only to prescription-drug advertisements (as defined and reached by 21 CFR 202.1 — not promotional labeling or other non-advertisement materials) that use one proprietary name or designation to refer to a combination of active ingredients present in more than one preparation (the preparations differing in the quantities of active ingredients and/or the finished dosage form), where no established name corresponds to that proprietary name or designation. In that circumstance, the ad must (a) prominently display the name of at least one specific dosage form, and (b) place the section 502(n) quantitative ingredient information in direct conjunction with that display. This rule does not address any equal-prominence obligation for quantitative ingredient information of other, additional dosage forms listed in the same advertisement; that obligation is a separate rule triggered when the advertisement lists dosage forms in addition to the one used for this required display.

Check

First confirm the trigger: is this a prescription-drug advertisement (not promotional labeling or other non-advertisement piece) that uses a single proprietary name/designation for a combination of active ingredients spanning more than one preparation (differing in ingredient quantities and/or dosage form), with no corresponding established name? If so, verify (a) the name of at least one specific dosage form is prominently displayed somewhere in the ad, and (b) the section 502(n) quantitative ingredient information is placed in direct conjunction with that specific display of the dosage form name. Flag as a violation if either: (i) no specific dosage form name is prominently displayed anywhere in the advertisement, or (ii) the section 502(n) quantitative ingredient information is not in direct conjunction with that display — e.g., separated by intervening text or graphics, or placed on a different page or screen. Do not evaluate here whether other, additional dosage forms listed in the ad have equal-prominence quantitative information; that is a separate check.

Escalate when

Escalate when it is unclear whether the piece is an "advertisement" within the reach of 21 CFR 202.1 (as opposed to promotional labeling or other material outside its scope), or whether it actually meets the triggering condition (single proprietary name covering a multi-preparation combination with no established name). Also escalate when the prominence of the dosage form name is borderline, or when whether the quantitative ingredient information is "in direct conjunction" with that display is debatable (e.g., same page but visually separated, or ambiguous layout).

The prominence of this listing of active ingredients shall bear a reasonable relationship to the prominence of the proprietary name and the relationship between such proprietary name or designation, and the listing of active ingredients shall be made clear by use of such phrase as “brand of”, preceding the listing of active ingredients. (2) The advertisement shall prominently display the name of at least one specific dosage form and shall have the quantitative ingredient information required by section 502(n) of the act in direct conjunction with such display. If other dosage forms are listed in the advertisement, the quantitative ingredient information for such dosage forms shall appear in direct conjunction and in equal prominence with the most prominent listing of the names of such dosage forms.
